Significant Matters

• Lead attorney in negotiation or mediation of multiple change order and delay claim disputes on behalf of the MBTA.
• Trial attorney in a Rhode Island federal district court case representing Emhart Industries, Inc., a subsidiary of Black & Decker, in which Emhart sought reimbursement of attorneys’ fees and costs arising from breach of defendant insurer’s duty to defend Emhart in connection with the remediation of a Rhode Island Superfund site.  The court awarded Emhart $4.2 million -- more than ninety percent of its fees and costs -- plus prejudgment interest in the amount of $1.4 million. 
• Represented Organogenesis, Inc., a Massachusetts bio-tech company, in its successful reorganization in bankruptcy.
• Represented GMAC in successful foreclosure and collection actions against bankrupt automobile dealerships and their principal owner.
