Adam Weisberger has substantial experience in complex corporate disputes, commercial litigation, and bankruptcy and insolvency matters, including representation of Chapter 11 debtors, secured creditors and creditors’ committees.
Previously at Foley Hoag LLP, Mr. Weisberger represented major companies, individuals and public agencies in commercial contract and tort, corporate governance, insurance coverage and indemnification disputes and is widely experienced in bankruptcy practice and related litigation.
Significant Matters
- Lead attorney in negotiation or mediation of multiple change order and delay claim disputes on behalf of the MBTA.
- Trial attorney in a Rhode Island federal district court case representing Emhart Industries, Inc., a subsidiary of Black & Decker, in which Emhart sought reimbursement of attorneys’ fees and costs arising from breach of defendant insurer’s duty to defend Emhart in connection with the remediation of a Rhode Island Superfund site. The court awarded Emhart $4.2 million -- more than ninety percent of its fees and costs -- plus prejudgment interest in the amount of $1.4 million.
- Represented Organogenesis, Inc., a Massachusetts bio-tech company, in its successful reorganization in bankruptcy.
- Represented GMAC in successful foreclosure and collection actions against bankrupt automobile dealerships and their principal owner.
