A seasoned commercial litigator with a substantial track record in complex, high-stakes cases, Pamela Berman has successfully defended noted brokerage houses against wide-ranging allegations, fought back scores of bad faith claims for national insurance companies, won favorable results in complicated environmental litigation, and more.
Her practice encompasses a full spectrum of commercial litigation, including NASD arbitrations, securities litigation, obtaining injunctive relief and pre-judgment security, aviation representation of domestic and global aircraft manufacturers, non-competition employment disputes, protection of trade secrets and commercial contract disputes. She also litigates bad faith, environmental coverage and asbestos insurance claims; lender liability, creditor’s rights, trademark and copyright infringement cases; and products liability, employment discrimination and labor issues. Pamela also handles criminal defense, defamation and legal malpractice defense.
Significant Matters
- She successfully defended Shearson Lehman Brothers in a federal criminal money-laundering case, obtaining acquittal after a six-week jury trial.
- She has obtained injunctive relief for numerous commercial clients in a wide variety of disputes, including non-competition, trade secret, brokerage and financial issues, trademark infringement, and the dissipation of assets.
- Pamela obtained a favorable judgment after trial for an energy limited-partnership in a case involving claims of fraud in a public offering.
- She has represented an aviation manufacturer in both contractual and product liability matters.
- For 20 years Pamela has represented brokers, brokerage houses and customers in NASD, FINRA and SEC arbitrations and investigations in cases involving claims of churning, unsuitability, unauthorized trading, negligent supervision and violations of securities laws.
- She has litigated non-solicitation and non-competition covenants for major brokerage houses and many other companies and industries.
- Over the years she as managed and defended more than 100 bad-faith claims against insurance companies, attaining favorable outcomes through aggressive litigation and persuasive negotiation.
- She obtained favorable results for an insurance company in major environmental coverage litigation involving more than 40 sites worldwide and more than 25 years of contested coverage.
