Rory Fazendeiro has significant experience representing clients in complex business and commercial litigation in state, federal and appellate courts and alternative dispute resolution venues.
Rory's experience includes shareholder litigation, partnership disputes, real estate litigation, non-competition and trade-secret litigation, securities and financial services litigation, employment-related disputes, general liability litigation and insurance coverage. His clients range across a broad spectrum of industries, including technology, real estate, construction and health care.
Formerly employed in the Securities Division of the Rhode Island Department of Business Regulation, he also counsels clients in corporate governance matters, employment issues, business transactions, financing and commercial real estate development and leasing. Outside the courtroom and the boardroom, he is a volunteer and member of the Greater Boston Council of the Jimmy Fund.
Significant Matters
- Represents and counsels commercial lenders on a broad array of loan workout and creditor's rights matters. Mr. Fazendeiro's experience includes matters relating to fraudulent transfers, valuation disputes, and lien priority claims, and he has advised lending institutions with regard to their rights under loan and security documents.
- For a real estate investment fund’s general partners, who faced breach of fiduciary duty and unfair and deceptive practices claims, Rory succeeded in obtaining dismissal of the most significant claims and ultimately a favorable settlement of the litigation.
- After a long and costly litigation in which his client finally overturned a wrongful employment action, Rory was able to recoup a substantial portion of the legal fees expended by his client through an appeal to the United States Court of Appeals for the Federal Circuit.
- Rory secured a favorable resolution for his client after successfully defeating statutory Wage-Act and treble damages claims in a federal court employment litigation.
- While lead attorney in real estate litigation involving novel legal issues, Rory's defense led to a judgment of dismissal and award of attorneys' fees in favor of his client, which were later upheld by the Massachusetts Appeals Court and Supreme Judicial Court.
