A noted environmental law and litigation attorney who has secured significant judgments in Massachusetts and Rhode Island courts for her commercial, governmental and educational clients, Kristen Sherman brings to her dual practice significant high-level experience in complex hazardous and solid waste, asbestos, air emission, water pollution, septic system, UST and wetland matters.

Client-dedicated and responsive, Kristen works to offer her clients excellent service and creative solutions to complex environmental problems, leading them through each step of regulatory processes and helping them achieve their goals. 

Her reputation as a leader in environmental law is the result of more than a decade of important work representing clients in state and federal courts and appearing before numerous state, federal and local regulatory commissions and public entities.  Before joining AP&S she worked in the Environmental and Land Use section of the Real Estate Department of Boston’s Choate, Hall & Stewart; as a volunteer attorney in the Environmental Protection Division of the Massachusetts Attorney General’s Office; and as a law clerk for McGregor & Shea, a leading Boston environmental boutique law firm. 

Significant Matters

  • Touret v. National Aeronautics and Space Administration (NASA).  Kristen and her AP&S team successfully defended Brown University as one of the defendants in an appeal brought by area residents under the National Environmental Policy Act (NEPA) seeking to reverse NASA and Department of Energy grants for a new $90 million life-sciences building.  They argued that the finding and the project were not “major federal actions” within NEPA’s scope, and the District Court for the District of Rhode Island agreed.
  • Rhode Island Resource Recovery Corporation (RIRRC) v. Rhode Island Department of Environmental Management (RIDEM).  In representing the RIRRC, Kristen helped obtain an injunction that prevented RIDEM from implementing regulations that would have resulted in a landfill deposit fee increase at the Central Landfill.  She joined other AP&S attorneys in leveraging solid-waste-industry relationships to oppose the fee increase and RIDEM has taken steps to repeal the fee.
  • Providence Journal Co. v. Rhode Island Convention Center Authority.  In a seminal case that clarified the Rhode Island Access to Public Records Act exemption for confidential commercial or financial information, she helped win a Rhode Island Supreme Court judgment for her client, the Rhode Island Convention Center Authority, allowing it not to disclose certain documents regarding event bookings at the convention center.
