Litigator Kyle Zambarano brings to his commercial clients in his complex commercial and employment litigation practices a deep knowledge and appreciation of the law gained, in part, from serving for two years as a law clerk for Chief Justice Frank J. Williams of the Rhode Island Supreme Court. Kyle specializes in litigating and resolving disputes between competing businesses and/or employers/former employees implicating trade secret law and non-competition provisions.
Significant Matters
- When a company involved in a dispute over a licensing agreement was sued for $20,000,000 in damages, Kyle helped win summary judgment for defendant on all counts.
- When a parent company was threatened with unlawful competition by a former employee, who was subject to a five-year non-competition provision agreed to in relation to the sale of a business, Kyle helped draft the successful motion for temporary injunctive relief.
- When a terminated employee was faced with the possible enforcement of a two-year non-solicitation provision, Kyle drafted the opposition memorandum that convinced a court to allow the terminated employee to work in his field of expertise.
- When an employer feared a competing business was raiding its employees in contravention of its employee’s non-competition provisions, Kyle convinced the competitor to enter into an agreement limiting future hiring.
- When a company wrongfully prevented minority shareholders from dissenting to a corporate merger, Kyle helped convince the court that the minority shareholders were entitled to fair payment for their shares.
- When a local credit union was sued by a former employee claiming she suffered from post-traumatic stress disorder caused by the termination of her employment, Kyle prior to trial successfully precluded a proffered expert witness from testifying as to that diagnosis, and then at trial won a defense verdict on that claim.
- When a national bank was faced with a lawsuit in relation to a debt owed by one of its customers, Kyle convinced a federal court to prohibit the lawsuit under Rhode Island’s trustee process statute.
- When a company delayed in filing suit, Kyle successfully moved to dismiss the action under a little-used statute of limitations pertaining to the sales of goods.
- When a state government wrongfully denied a criminal defendant access to grand jury records after the criminal charges were dismissed, Kyle successfully convinced a court to release those records, despite the fact that, in many instances, those records are kept confidential.
