955, LLC d/b/a/ Dillon's v. 955 Boylston Street

We successfully represented The Glynn Hospitality Group and certain of its subsidiaries in connection with the acquisition of 955 Boylston Street, Boston, Massachusetts.  An affiliate of our client occupies the real property pursuant to a lease and operates a restaurant and bar at the site known as Dillon's.  The lease contained a right of first refusal in favor of the tenant.  The Glynn Hospital Group retained Adler, Pollock & Sheehan to represent its affiliate in connection with a dispute with the landlord with respect to the right of first refusal.  We successfully obtained an ex parte lis pendens with respect to the property.  This victory ultimately compelled the landlord to convey the property to our client upon the terms and conditions set forth in the complaint we filed on behalf of the client.  We also represented the client in connection with the acquisition of the subject property and the completion of a 1031 Tax-Free Exchange.  We were able to provide the client with a full range of legal services and effected a seamless transition of this matter from its inception as litigation to its completion as a successful real estate acquisition.
