{"id":53,"date":"2015-09-17T18:42:40","date_gmt":"2015-09-17T18:42:40","guid":{"rendered":"https:\/\/www.apslaw.com\/its-your-business\/?p=53"},"modified":"2023-04-25T09:48:33","modified_gmt":"2023-04-25T13:48:33","slug":"rhode-island-legislature-mandates-statewide-building-permit-fee-formula","status":"publish","type":"post","link":"https:\/\/www.apslaw.com\/its-your-business\/2015\/09\/17\/rhode-island-legislature-mandates-statewide-building-permit-fee-formula\/","title":{"rendered":"Rhode Island Legislature Mandates Statewide Building Permit Fee Formula"},"content":{"rendered":"<p>Every municipality in Rhode Island is vested with the power to establish a formula to calculate building permit fees for development within its jurisdiction.\u00a0 Building permit fees are meant to offset the cost for municipalities to: 1) review plans for building permits; 2) oversee and regulate building and construction; 3) conduct necessary inspections; and 4) issue certificates of occupancy.\u00a0 However, the current piecemeal system has resulted in significant differences in building permit fees from municipality to municipality.\u00a0 More importantly, the current system has resulted in building permit fees in excess of the actual cost to municipalities to approve and oversee construction.\u00a0 As a result, the Rhode Island Builders Association brought a class-action lawsuit against three municipalities challenging the methodology for calculating building permit fees.\u00a0 <em>See Rhode Island Builders Association, et al., v. Pagliaro, et al.<\/em>, C.A. No. PC-2005-5919 (R.I. Super. Ct. 2005).<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 These issues are amplified for construction of large developments.\u00a0 Given that building permit fees for large developments can be well in excess of a million dollars, these fees can serve as a significant hurdle to the economic viability of large-scale projects.<\/p>\n<p>To address these issues and ensure consistency across the State, the General Assembly enacted an amendment to the building permit fee computation statute, which went into effect on July 10, 2015.\u00a0 R.I. Gen. Laws \u00a7 23-27.3-119.0, as amended, states:<\/p>\n<p><a href=\"https:\/\/www.apslaw.com\/its-your-business\/wp-content\/uploads\/sites\/3\/2015\/09\/Statewide-Building-Permit-Fee.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-55\" src=\"https:\/\/www.apslaw.com\/its-your-business\/wp-content\/uploads\/sites\/3\/2015\/09\/Statewide-Building-Permit-Fee.png\" alt=\"Statewide Building Permit Fee\" width=\"651\" height=\"336\" title=\"\" srcset=\"https:\/\/www.apslaw.com\/its-your-business\/wp-content\/uploads\/sites\/3\/2015\/09\/Statewide-Building-Permit-Fee.png 651w, https:\/\/www.apslaw.com\/its-your-business\/wp-content\/uploads\/sites\/3\/2015\/09\/Statewide-Building-Permit-Fee-300x155.png 300w\" sizes=\"auto, (max-width: 651px) 100vw, 651px\" \/><\/a><\/p>\n<p>Based on this amendment, it is clear that the General Assembly intended to establish a statewide formula and ensure that high-value construction projects are protected from excessive building permit fees through the use of a decreasing multiplier.\u00a0 The Legislative Council notes appended to the legislation further supports this analysis:<\/p>\n<blockquote><p>This act would provide that fees paid for construction permits shall be assessed by all municipalities using a formula established and\/or approved by the Rhode Island building code commission <em>which has multipliers that decrease as construction costs increase in value commencing on July 1, 2016<\/em>. (Emphasis added.)<\/p><\/blockquote>\n<p>The statewide new building permit fee formula will be promulgated by the R.I. Building Commissioner to all municipalities in Rhode Island on December 1, 2015.\u00a0 The new formula will go into effect on July 1, 2016.\u00a0 This new statewide building permit fee formula will likely help stimulate larger construction projects across the state and eliminate the questionable legality of some municipalities\u2019 building permit fee formulas.<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> This class-action lawsuit resulted in a settlement paid by three municipalities to those who were aggrieved by the excessive building permit fees.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Every municipality in Rhode Island is vested with the power to establish a formula to calculate building permit fees for development within its jurisdiction.\u00a0 Building permit fees are meant to offset the cost for municipalities to: 1) review plans for building permits;&#8230;<\/p>\n","protected":false},"author":8,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[8],"tags":[15,10,16],"class_list":["post-53","post","type-post","status-publish","format-standard","hentry","category-real-estate-law","tag-building-permits","tag-real-estate","tag-statewide-building-permit-fee"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/posts\/53","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/users\/8"}],"replies":[{"embeddable":true,"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/comments?post=53"}],"version-history":[{"count":0,"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/posts\/53\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/media?parent=53"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/categories?post=53"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.apslaw.com\/its-your-business\/wp-json\/wp\/v2\/tags?post=53"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
