{"id":52,"date":"2013-05-17T14:03:01","date_gmt":"2013-05-17T14:03:01","guid":{"rendered":"https:\/\/www.apslaw.com\/on-appeal\/?p=52"},"modified":"2023-07-31T17:01:09","modified_gmt":"2023-07-31T21:01:09","slug":"52","status":"publish","type":"post","link":"https:\/\/www.apslaw.com\/on-appeal\/transcripts\/52\/","title":{"rendered":"(3) Failure to Order Transcript Fatal to Appeal."},"content":{"rendered":"<p>The Supreme Court has consistently reminded parties that the failure to order a transcript of the proceedings below is \u201crisky business.\u201d\u00a0 <em>See Sentas v. Sentas<\/em>, 911 A.2d 266, 270 (R.I. 2006); Bergquist v. Cesario, 844 A.2d 100, 105 (R.I. 2004).\u00a0 It is well settled that the Court \u201cordinarily will not decide matters . . . unless there has . . . been transmitted . . . so much of the record of the tribunal below as may be necessary to enable us to pass on the question at issue.\u201d\u00a0 <em>Savoy Realty Corp. v. LPL, Inc<\/em>., 401 A.2d 61, 61 (R.I. 1979).\u00a0 Nevertheless, cases continue to reach the Supreme Court without transcripts.<br \/>\nIn <a href=\"http:\/\/www.courts.ri.gov\/Courts\/SupremeCourt\/Opinions\/12-177.pdf\" target=\"_blank\" rel=\"noopener\">Vogel v. Catala, 2012-177-Appeal<\/a>, the appellant proceeded without ordering a transcript.\u00a0 At oral argument, in response to the Court\u2019s inquiry, appellant\u2019s counsel informed the Court that he had ordered the transcript on appeal.\u00a0 <em>Id<\/em>. at 2 n.1.\u00a0 However, on his notice of appeal, appellant affirmatively indicated that he would not be ordering a copy of the transcript.\u00a0 <em>Id<\/em>.<br \/>\nOn appeal, the appellant argued that the trial justice erred in finding that the appellee was a credible witness and in failing to find that a contract at issue was void as a loan for betting.\u00a0 <em>Id<\/em>. at 4.\u00a0 However, without a transcript of the trial below, the Supreme Court was unable to review the trial justice\u2019s factual findings.\u00a0 <em>Id<\/em>. at 5.\u00a0 Indeed, without the transcript, the Court could only speculate as to the testimony adduced at trial, which it declined to do.\u00a0 <em>Id<\/em>. at 5-6.\u00a0 Thus, the appellant\u2019s failure to order the transcript was fatal to his appeal.\u00a0 <em>Id<\/em>. at 6.<br \/>\nJustice Robinson dissented on the ground that there was sufficient evidence in the record for the Court to conclude that appellee, by virtue of his own judicial admissions, was statutorily barred from recovering because the contract was void.\u00a0 <em>Id<\/em>. at 6.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court has consistently reminded parties that the failure to order a transcript of the proceedings below is \u201crisky business.\u201d\u00a0 See Sentas v.
