{"id":931,"date":"2025-10-30T09:24:19","date_gmt":"2025-10-30T13:24:19","guid":{"rendered":"https:\/\/www.apslaw.com\/its-your-business\/?p=931"},"modified":"2025-10-30T09:24:19","modified_gmt":"2025-10-30T13:24:19","slug":"client-alert-proposed-ridoh-regulations-update-the-official-regulatory-definition-of-compounding","status":"publish","type":"post","link":"https:\/\/www.apslaw.com\/vital-signs\/2025\/10\/30\/client-alert-proposed-ridoh-regulations-update-the-official-regulatory-definition-of-compounding\/","title":{"rendered":"Client Alert: Proposed RIDOH Regulations Update the Official Regulatory Definition of Compounding"},"content":{"rendered":"\n<p>On October 28, 2025, the Rhode Island Department of Health (\u201cRIDOH\u201d) issued a public notice of a proposed amendment to <a href=\"https:\/\/rules.sos.ri.gov\/promulgations\/part\/216-40-15-1\" target=\"_blank\" rel=\"noopener\">216-RICR-40-15-1: \u201cPharmacists, Pharmacies, and Manufacturers, Wholesalers, and Distributors\u201d<\/a> (the \u201cProposed Rule\u201d). Among the notable changes, RIDOH updates its definition of \u201ccompounding.\u201d Specifically, it adds to the definition that the \u201c[a]ddition of vitamins, nutrients, and\/or medications to intravenous fluid bags is compounding.\u201d<\/p>\n\n\n\n<p>Physician practices, IV therapy practices, wellness clinics, and any other practice that is offering IV vitamin, nutrient, or medications should take note of this update. As a result of its interpretation of USP 797 guidance and regulatory definitions, RIDOH had previously <a href=\"https:\/\/health.ri.gov\/sites\/g\/files\/xkgbur1006\/files\/publications\/guidance\/Medical-Spa-and-IV-Therapy-Business.pdf\" target=\"_blank\" rel=\"noopener\">stated<\/a> that the addition of vitamins, nutrients or other non-standard additives to a sterile bag constitute \u201ccompounding.\u201d The Proposed Rule now codifies that prior interpretation.<\/p>\n\n\n\n<p>If providers have comments on the Proposed Rule regarding the definition of compounding, the window to submit comments for RIDOH\u2019s consideration is now open. The public may submit comments on or before November 27, 2025.
