Defense Verdict Received on Behalf of Equipment Manufacturer Client

On September 28, 2023 a jury in the United States District Court for the District of Massachusetts, returned a defense verdict on behalf of our client, an equipment manufacturer that supplied boilers to the U.S. Navy for use onboard a ship that Plaintiff’s late husband served on. The Plaintiff asked for $20 million in compensatory damages and $43 million in punitive damages. The trial lasted three weeks and after approximately 5 hours of deliberation, the jury came back with a complete defense verdict on the following grounds: 1) that Plaintiff has not proven by a preponderance of the evidence that our client breached the implied warranty of merchantability by selling boilers that were defective due to a failure to warn and 2) that Plaintiff has not proven by a preponderance of the evidence that our client was negligent by failing to provide warnings about its boilers.
