AP&S Litigation Team Guides Gourmet Food Company to Recovery of Lost Revenues
In January 2010, gourmet food and cured meat company Daniele, Inc. purchased contaminated pepper from two different spice companies and, as a result, was forced to recall over a million pounds of its salami and other cured meat products. This recall was embarrassing to Daniele and severely hurt its reputation and customer relationships. Worst of all, Daniele found itself uninsured for the substantial lost revenue and expenses associated with the recall.
Daniele asked AP&S to help the company recover some of its financial losses resulting from the recall. AP&S brought suit against both spice companies as well as the insurance broker that failed to procure appropriate insurance coverage for Daniele.
AP&S obtained a 33 million dollar judgment against one spice company and reached a negotiated resolution with the other. The firm also successfully resolved the claim it brought against the insurance broker. Ultimately, Daniele was vindicated through these lawsuits. The money recovered with the assistance of AP&S, combined with Daniele’s relentless dedication to quality and the superior taste of its products, has allowed the company to continue to grow and thrive. In October 2014, Daniele completed construction on a $60-million factory, which is the largest and most modern plant of its kind in the world.
