Nicole Benjamin Authors RI Chapter of The Law of Class Action: Fifty-State Survey

For the ninth consecutive year, Nicole Benjamin has authored the Rhode Island chapter of The Law of Class Action: Fifty-State Survey. The Law of Class Action: Fifty-State Survey 2021 is a valuable tool for both in-house and outside counsels who confront the prospect of litigating class actions in state forums with which they may have little or no experience and must make informed recommendations on removal. To help practitioners and parties quickly identify the differences in each state’s laws, The Law of Class Action: Fifty-State Survey 2020 contains an up-to-date analysis of class action law in each of the fifty states, which addresses changes in rules and statutes as well as significant case law.

In recent years, the State survey has been republished in the Newberg Class Action treatise, one of the most authoritative publications on class action law.

Nicole’s contribution to this work compliments her class action practice. She has defended numerous class actions in state and federal court, including high-stakes pension litigation, which resulted in a class action for settlement purposes. She has participated in and examined witnesses in a five-day fairness hearing, which resulted in approval of the settlement, a decision that was later affirmed on appeal to the Rhode Island Supreme Court. See https://www.apslaw.com/case-studies/state-pension/  In addition, for six years, Nicole worked with the antitrust litigation team of a “Global Elite” – ranked international law firm in representing a leading specialty pharmaceutical company in a multi-district litigation class action antitrust case from its commencement through jury empanelment and its eventual resolution on the eve of trial. She has defended against a wide variety of other class action claims, including stock-drop claims, claims for violations of the Employee Retirement Income Security Act of 1974 and violations of securities laws.
