Robert Brooks and Julie Sacks won summary judgment for plaintiffs, Michael F. Sabitoni, a trustee of multiemployer pension, annuity, and health and welfare benefits plans, and the Rhode Island Laborers’ District Council of the Laborers’ International Union of North America, AFL-CIO. Judge William E. Smith of the U.S. District Court for the District of Rhode Island ruled that there was no genuine dispute that an employer was liable for unpaid and delinquent contributions to employee benefit plans where contributions were mandated by the terms of a collective bargaining agreement, and where the employer acknowledged owing contractually mandated amounts for each hour worked by its employees, union members covered by the agreement.
