On October 6, 2021, Mike Chittick, Kyle Zambarano and Steve Lapatin won summary judgment in U.S. District Court for Rhode Island on behalf of Twin River Casino Hotel. A Twin River employee, Elizabeth Sankey, sought monetary damages against Twin River for various claims, including alleged malicious prosecution, defamation, and intentional infliction of emotional distress, arising out of the employee’s arrest by the Rhode Island State Police Gaming Enforcement Unit for unlawful possession of a controlled substance at work. Although the criminal charge against Ms. Sankey was eventually dropped and she returned to her job, she nevertheless chose to pursue additional monetary relief against Twin River.
Following the completion of discovery, AP&S moved for summary judgment on Twin River’s behalf. In granting the motion, U.S. District Court Chief Judge John J. McConnell, Jr. rendered a complete and resounding victory for Twin River, dismissing all of Ms. Sankey’s claims as lacking in merit.
